    Hola a todos,
    ¿Técnicamente cual es la diferencia entre remand in custody vs temporary arrest?

    remand in custody= prisión preventiva
    temporary arrest= detención preventiva

    No tengo dudas con respecto a la traducción, pero si a la diferencia.

    Alguien que entienda sobre el tema?

    I can't say how it is in other countries but in the U.S. the difference between an arrest and to remand in custody is that an arrest is done by the police and a judge remands.

    Generally:

    Arrest: A judge can order an arrest by issuing a warrant but cannot make the arrest. The police serve the warrant and make the arrest. (the police can also arrest people without a warrant).

    Remand: Once arrested a person is brought before a judge to determine if there is sufficient reason (evidence) to hold a person on the charges. If the judge rules that there is sufficient evidence then he will set bail so that the person can be released pending trial. If the person cannot make bail then the judge will remand him to the custody of the appropriate authority (usually the sheriff) having jurisdiction where he will be held until he makes bail or the charges are otherwise resolved through trial or dismissal.

    Note: Diego, I would be intrested in knowing how you are using the term "temporary arrest". That is unusual term and I'm curious to know if that is something regarding the U.S. legal system.

    Ante todo muchas gracias por tu explicación, muy útil y clara.

    Con respecto a "temporary arrest" en mi país significaría detención preventiva, y esto está escrito en un exhorto que estoy traduciendo, no puedo darte mucha info, porque es sobre una caso muy serio, pero te transcribo parte de este:
    El presente exhorto se libra al Juez ............, a fin de solicitarle formalmente que ordene la DETENCIÓN PREVENTIVA de xxxxxx.

    Como vos me explicás el juez en este caso debe librar la orden. Esta persona ya se encuentra bajo custodia de la Patrulla Fronteriza de USA. Ahora se pide su "detención preventiva" Lo busqué en google y por las paginas que leí , Temporary arrest, coincide con lo que te cuento.

    Si estoy muy equivocado, please hacémelo saber. Gracias nuevamente DIEGO

    Mira lo que he contarado yo, no soy experta en el tema.

    En español sería presos preventivos o no sentenciados. Remand en inglés significa devolver a un preso o acusado a prisión en espera de ulterior procedimiento o la continuación de uno ya iniciado.

    Yo creo que te va mejor remand.

    Mira, estos términos te pueden venir bien para la traducción:

    remand centre cárcel transitoria
    remand home cárcel transitoria para menores
    remand prisoner prisionero devuelto (a la cárcel a esperar juicio)
    remand prisoner prisionero reencarcelado (en espera de juicio)



    Temporary arrest no lo veo, pero sí esto:


    warrant of arrest orden de detención judicial


    Bueno, lo sabrá mejor Vicente.

    Diego,

    Temporary arrest is not a legal term in the United States, however, it is often used in the media when a political figure is held at their residence and not allowed to make speeches or leave the country.

    On occasion, I have also seen the term used to mean "temporary detention". This is a legal term referring to holding a person for a short period of time (for an interview/interrogation, awaiting evidence to make the arrest, etc.) before or without making an arrest.

    Hola Diego!!

    Si no estoy tarde. La frase "temporary arrest" me molesto un poco porque no la conozco y no creo que sea común. Permíteme suregir "temporary detention". Yo sé que la Patrulla Frontera prefiere referir a los imigrantes ilegales como "detainees". Although they are tecnically under arrest, most are only going to be held temporarily until they can be returned to their home country, so therefore they are in temporary detention.

    In short, the U.S Immigration authorities prefer the words detain, detention and detainee over arrest, incarceration, subject or suspect.

    Exx's post reminded me of something regarding "remand" that further clarifies the term. A detained person is always held by law enforcement officials in a jail, prison or detention facility. When they are brought to court and their case is not resolved then the judge "remands" or returns them back to the proper authorities.
