    Default Concept of a "Living Will"

    Trying to translate the concept of an Advanced Directive ( another name for a Living Will) into Spanish. Is there an idiom that does this that retains the sameconcept in the Spanish speaking world.

    Directivo avanzado or testamento vivo seem insufficient.

    Please help,

    Hi all!

    Aunque el término que ha tenido mayor difusión es “testamento vital”, traducción literal del inglés del instituto jurídico denominado living will, sugiero la utilización del término “testamento anticipado” para no acarrear la confusión que el término acuñado ya suscitara en Estados Unidos.

    El término testamento está extremadamente asociado con el acaecimiento de la muerte.

    Igualmente, te sugiero que utilices "directivas anticipadas" para "advance directives", dado que éste sería el género. El "living will" sería una manera de instrumentarlo.

    En España, el término "documento de voluntades anticipades" se impuso como traducción del instituto que en inglés se denomina advance directives, aunque en algunas ocasiones también se ha utilizado la frase “directivas anticipadas”. Probablemente, la elección de ese país se base en el énfasis en la voluntad del paciente que, como se ha visto, tanto se prioriza.

    Es correcto Guadalupe!!! En un curso sobre este tema esto es lo que transcribió la profe:

    Lo más cercano que contempla nuestro derecho (Argentina) es la DECLARACIÓN DE VOLUNTAD ANTICIPADA que, desde hace unos días, ya tiene fuerza de ley en Río Negro. Transcribo dos artículos del proyecto de ley:


    ARTICULO 1º: Toda persona capaz tiene el derecho de expresar su consentimiento o su rechazo con respecto a los tratamientos médicos que pudieren indicársele en el futuro, en previsión de la pérdida de la capacidad natural o la concurrencia de circunstancias clínicas que le impidan expresar su voluntad en ese momento.
    ARTICULO 2º: El derecho mencionado se ejercerá mediante una “Declaración de Voluntad Anticipada” (DVA), entendiéndose por tal la manifestación escrita, datada y fehaciente, de toda persona capaz que libremente expresa las instrucciones que deberán respetarse en la atención y el cuidado de su salud que reciba en el supuesto del artículo anterior.

    Hola! yo siempre lo vi como TESTAMENTO EN VIDA, pero eso es en Argentina... cual es el target de tu traducción?

    Thanks for all the wonderfull replies they were very helpful! Since my targeted audience is here in Houston, TX the majority of the readers are from Mexico, Guatamala, and Beliz. Of course it it also very common to find people of other nationalities such as Colombian, Argentinian, and Venezuelan.

    Since my intent was to use the phrase as part of a question on a medical form I ended up using the following.

    ¿Ud. tiene una declaración de voluntad anticipada (o testamento vital)?

    [The doctor wanted to know in case the procedure went wrong.]

    Default Testamento Viviente

    "Testamento Viviente" is the only way that I have translated "Living Will", due to seeing other reputable translators only use that particular phrase for that translation.

    "Testamento Viviente" was the only phrase I knew of until now. The others offered here are legitimate also, and I'll be able to incorporate them in future work. Something new learned every day.
