Default Signed as a deed and delivered

Does anybody know how to translate this expression into Spanish? It appears at the end of an Agreement on the transfer of shares. Thanks a lot!

Just to be absolutely sure about the proper translation, please tell me if the signature belongs to a notary public?

    Thanks.
