Notice of motion es "notificación del inicio del incidente". Motion es incidente, no solicitud. Ni petición. Un motion dirime una cuestión pre o inter juicio que es fundamental para su continuación u posterior decisión.
Un incidente se tramita de la siguiente manera: una demanda incidental (motion), contestación a la demanda incidental (response to motion) y una audiencia en donde se valorarán las pruebas que se tengan para acreditar la porcedencia del incidente. |
