    Les ruego su ayuda para poder traducir o entender el sentido, en una cláusula contractual de: " in consideration of the mutual agreements and promises contained herein and for other good and valuable consideration, the Parties agrees as follows:

    Esto no se refiere solo a la buena voluntad entre las partes, implica una responsabilidad pecuniaria. Alquien puede retroalimentarme? Gracias y saludos!!

    Marybel, "Good and valuable consideration" se traduce como: "contraprestación válida y susceptible de apreciación pecuniaria". Efectivamente, es lo que se da a cambio y es algo que tiene valor en dinero.
    Llego un poco tarde con esto, pero recién me registro.

    Maribel!! Mi opción para " for good and valuable consideration" es " a título oneroso", como opuesto a "a título gratuito", es decir, en el contrato existe una contraprestación. El típico ejemplo es la compra venta.

    Hola a todos; para serles sincera, el término "conisderations" en este contexto específico no me pareciera adoptar el significado de contraprestación. Pareciera mas bien referirse a los motivos expuestos para la ejecución del contrato (cláusula de "considerandos" o "Whereas clauses ".

    Yo lo traduciría así: En virtud de los acuerdos y compromisos estipulados en el presente contrato y por otros motivos de peso las partes acuerdan lo siguiente:.......

    "for good and valuable consideration, como dice mmartasembe, es precisamente "a título oneroso". No hay otra traducción posible

    Estimados colegas, estaría de acuerdo con Uds. si la frase no incluyera la patabra "other"

    No obstante la cláusula reza: in consideration of the mutual agreements and promises contained herein (es decir en virtud o en razón de los los acuerdos y compromisos establecidos a ese contrato) y seguidamente dice "and for other good and valuable consideration (es decir por otras razones adicionales a las mencionadas).

    Es por eso que sigo creyendo que en este caso no se trata de contraprestación si no de los motivos o “considerandos” que dan pié a la ejecución del contrato.

    My turn: En compensación por los acuerdos y promesas mutuas establecidas y como (otra) contraprestación a título oneroso, las partes acuerdan lo siguiente:

    P.D. La existencia del término "other" no creo que prive a la expresión "for good and valuable consideration" de su sentido en este contexto, a saber: a título oneroso.

    Respeto tu criterio Dani; pero yo sigo sin asociar los elementos que se enumeran al inicio de la cláusula ( "promises and mutual agreement") con pagos de contraprestaciones. Es por eso que la palabra "otras" a mi modo de ver si desvirtua que lo que sigue se relacione con obligaciones pecunarias. De todas formas como lo indiqué al comienzo, respeto tu criterio aunque difiera de el msimo

    Default Consideration

    In the English legal system, consideration is essential for a contract. I got the following from the Oxford Dictionary of Law:

    Consideration: n. An act, forbearance, or promise by one party to a contract that constitutes the price for which he buys the promise of the other. Consideration is esential to the validity of any contract other than one made by deed. Without consideration an agreement not made by deed is not binding.... The doctrine of consideration is governed by four major principles. (i) A valuable consideration is required, i.e. the act, forbearance, or promise must have some economic value. Good consideration (natural love and affection or a moral duty) is not enough to render a promise enforceable...

    Therefore, I think Hebe is right in that in the sense in which this term is being used is not directly money, it is used in the sense that it is part of a valid contract. As part of a valid contract it has to be valuable, ie it must have some economic value, but it does not have to be money, it can be service of some kind that has an economic value.

    This term does not have an equivalent in Spanish, because the Spanish world has the Roman Legal System, not the English one, and the specific terms sometimes have no equivalent. I am presently studying for a degree in Law, and I've been studying Contracts over the past 12 months, so I hope you find this information useful.
